Renter's Agreement

1. The Parties

This Equipment Lease Agreement is made and entered into on the day of agreement. It is between Camping Ala Carte, LLC and the registered customer.

2. Equipment

The Owner and Renter agree to enter into a binding agreement for the lease of the equipment listed under said customer’s account.

3. Term

The lease period begins and ends on the agreed upon dates within the customer’s account.

4. Payments

The Renter agrees to pay Camping Ala Carte the agreed price of items placed in their cart and agrees to the payment made.

5. Security Deposits

Each customer order will require a $100 deposit to cover any loss or purposeful damage to our equipment. The cost of a replacement item will be transparent – original cost of product minus depreciation for past use. Security deposits will only be authorized but not processed except in the event of loss or damage. A release/return of the security deposit is required within 7 days – our goal is to release it within 3 days.

We take pride in the gear we rent and fully inspect all our gear for cleanliness, damage, and proper operation. We ask that you also inspect the equipment upon pick-up and notify us immediately of any problems so we can replace any unsatisfactory equipment. If you experience a problem with any of the equipment during the rental period that is a result of gear not performing properly or being in unsatisfactory condition, we will do our best to replace it ASAP or credit you for the time you were unable to use it.

Examples of damage would include but are not limited to punctures, tears, stains, and/or missing components. Normal wear and tears shall include minor scrapes, abrasions or evidence of use consistent with responsible use of the rental equipment. If you return damaged equipment, you will only be charged for the cost of repairs and nothing more, unless a full replacement is required.

6. Late Fees

Failing to return the rented equipment as agreed in your order will result in additional day/s charges. If you would like to extend your rental with us, please contact us and we will do everything we can to make that possible. If the equipment is not needed for other rentals, you will only be charged for the additional days used. If the equipment is needed for other rentals, you could be charged the suggested manufacturers’ cost to purchase additional equipment for the reserved rental.

7. Use of Equipment

The Renter (customer) agrees to use the Equipment for its intended use. Any use of the Equipment outside of its intended use or for unlawful purposes will violate this agreement and could result in additional charges beyond the agreed upon daily rates and security deposits.

8. Renter’s Responsibility

It is the Renter's responsibility to maintain the Equipment in accordance with industry standards during the rental term dates. Any repairs, modifications, or damage caused to the Equipment, except for common wear and tear resulting from its intended use, shall be the Renter’s responsibility.

9. Repairs

If, at any time, the Equipment ceases to function in its intended use at no fault of the Renter, the Owner agrees to either:

a.) Replace the Equipment. Camping Ala Carte shall replace the Equipment with another that is equal in respect to function, features, and purpose. During the exchange period under which the Renter had notified Camping Ala Carte of the need for equipment replacement, no payment for said equipment will be charged for loss of use.

10. Default

In the event of any default by the Renter (customer), Camping Ala Carte may terminate this Agreement and take possession of the Equipment without prejudice to any other remedies the Owner may have.

11. Indemnification

The Renter shall indemnify and hold the Owner harmless from any loss, damage, or expense arising from the Renter’s possession, use, or misuse of the Equipment.

12. Entire Agreement

This Agreement constitutes the entire agreement between the Owner and the Renter (customer) concerning the subject matter hereof and supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written.

13. Ownership

Under this Agreement, the Equipment shall remain the property of Camping Ala Carte and must be returned to the Owner in the same condition as at the start of the Rental Agreement (dates), normal wear and tear excepted.

14. Governing Law

This Agreement shall be governed under the laws located in the State of South Carolina.

15. Venue; Choice of Law:

The Parties hereby agree that the exclusive venue for the resolution of any dispute arising under this Agreement, or in any way related hereto, shall be in a state court in Oconee County, State of South Carolina. Any and all disputes between the Parties arising hereunder, or in any way related hereto, shall be decided in accordance with the laws of the State of South Carolina, conflicts of law notwithstanding.

16. WAIVER OF RIGHT TO TRIAL BY JURY:

THE PARTIES ALSO HEREBY UNEQUIVOCALLY, UNCONDITIONALLY, AND ABSOLUTELY WAIVE THEIR RIGHT TO TRIAL BY JURY FOR ANY ISSUES ARISING UNDER THIS AGREEMENT OR IN AY WAY RELATED HERETO.
